Terms & Conditions
These terms & conditions of sales regulate the terms between the customer and the seller at
dmm.ee from the e-shop.

1. Terms of sale
1.1. Terms and conditions of sale are valid from the customer and seller of www.dmm.ee online store at DM MARKETING OÜ, when purchasing goods and services.'
1.2. In addition to these conditions, the Law of Obligations Act (hereinafter referred to as the "Law of Obligations Act"), the Consumer Protection Act (hereinafter TKS) and other legal acts in force in the Republic of Estonia are governed by legal relations arising from the purchase of products from DM MARKETING OÜ online store.
1.3. DM MARKETING OÜ reserves the right to modify the terms of sale. These changes are reflected on the website www.dmm.ee
1.4. The images of the products in the web store are illustrative and may differ from actual products.
1.5. In the description of the products in the online store may be unintentional errors.
1.6. DM MARKETING OÜ has the right to cancel the sales agreement entered via online store without any sanction and penalty and not to ship the products in the following cases:
 - the goods are out of stock;
 - the price or features of the goods are displayed incorrectly due to system error in the online             store system;
 - if the buyer does not meet the conditions set by DM MARKETING OÜ.

If DM MARKETING OÜ can not fulfill the order and if the customer has made an advance payment for the goods, DM MARKETING OÜ will contact the customer and will refund the amount paid.

2. Prices
2.1. All prices in the online store of DM MARKETING OÜ are in euros (EUR) and include current VAT of 20%.
2.2. During a campagin period, a discount will be applied to selected products by DM MARKETING . Please note that product campaigns are listed/displayed on the front page of the online store or in social media of DM MARKETING.
2.3. New, promotional price of the campaign will be displayed on the product page of DM MARKETING online store.
2.4. The promotional price may also be applied through a promotional code. In this case the discounted price will be displayed at the latest upon entering a code of the campaign;
2.5. A fee for shipping is added to the product price according to the delivery method chosen by the customer.
2.6. Prices are valid from the time when the order is completed until the expiry of the due date of the completed order (2 days after the order is completed).
2.7. Payment for orders shall, at the choice of the client, be either: (a) by bank transfer or (b) through a bank link.
2.8. If there is a campaign for free transportation, the customer must choose a delivery method, and the discount price will be displayed at the latest when confirming the basket.

3. Placing an order
3.1. Add the item to your cart.
3.2. To see the shopping cart content, select " Check out" from the top of the page.
3.3. To complete the order, select the appropriate delivery method for you.
3.4. The basket will remain the same if you leave the basket.
3.5. After selecting the shipment method, please confirm "I agree to the terms and refund policy" and then select "Check out now ".
3.6. After entering the data, select "Review order".
3.7. For a promotional code (percentage from cart, free shipping, fixed discount amount, etc.), to get a discount, select the order overview page "Got a discount code?" and enter the discount code. Then click on the "Apply" button. Different promotional codes are also subject to different conditions that are always included in the campaign terms&conditions. Please follow them carefully.
3.8. To confirm the order, select the appropriate payment method: a) Pay with invoice b) Swedbank, SEB, Luminor, Danske, LHV, Coop, Pocopay.
3.9. Orders made at DM MARKETING OÜ online store are processed on working days from Monday to Friday at 09:00 to 14:00. If the order is placed on Friday after 14:00, the order will be confirmed and completed on the following Monday.

4. Validity of contract of sale
4.1. With the contract of sale of goods, DM MARKETING OÜ undertakes to transfer the existing goods to the customer and make it possible for the customer to transfer ownership. However, the customer undertakes to pay DM MARKETING OÜ the amount indicated on the invoice for the goods and accept the goods.
4.2. Orders that have not been paid will be canceled within 5 days of the order completion.
4.3.The sales contract takes effect after the payment has been made by the customer to the bank account of DM MARKETING OÜ.

5. Shipment
5.1. After the sales contract has been confirmed, goods can be delivered in two ways:
 5.1.1. The item will be shipped to Itella SmartPOST or Omniva parcel terminal (in Estonia) marked  on the order (see page „Delivery terms“ in more detail);
 5.1.2. Picking up the package from DM MARKETING office on the basis of a prior agreement with  DM MARKETING team.
5.2. All shipments within Estonia generally arrive at the destination specified by the customer within 2-3 business days of the date of entry into force of the contract of sale.
5.3. Terms of delivery indicated on the website of DM MARKETING OÜ are valid from the moment the invoice of the order amount has been transferred to the online store account.
5.4. In order to deliver without a delay, the customer must submit correct and valid data when entering the delivery data when ordering.
5.5 DM MARKETING OÜ is not responsible for the delay of the delivery if the goods have been delivered to the logistics partners at the right time, but the delivery is delayed due to circumstances that DM MARKETING OÜ could not influence or anticipate.
5.6. We have the right to ship goods in up to 45 calendar days in exceptional cases.


6.Right of withdrawal
6.1. After receiving the order, the customer has the right to withdraw from the contract entered into with the online store within 14 days. The right of withdrawal does not apply if the buyer is a legal person. Legal persons are not entitled to 14 days' right of withdrawal.
6.2. The returnable product must be complete (include the product packaging and all the items in the product packaging, etc.). If a product has been purchased under a campaign in which another product has been added to the product, you must return the entire set (i.e., all products).
6.3. If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics and functioning of the goods, or if there are any signs of use or wear and tear, the online store has the right to lower the amount returned in accordance with the decrease in the value of the goods. The customer should handle and use the products as if they were allowed to do so in the normal way in the shop.
6.4. In order to return the goods, an application for withdrawal of goods in free form must be submitted and sent to abi@fmm.ee not later than within 14 days upon receipt of the goods.
6.5. The customer must return the goods within 14 days following the submission of the application or provide proof that they have delivered the goods to the logistics company during the aforementioned period.
6.6. Upon receiving the returned goods, the online store shall return to the customer, immediately but no later than after 14 days, all of the payments received from the customer based on the contract, including the cost of delivery of the used item by the customer, unless the purchaser has chosen the way of delivery the cheapest way of delivering the item proposed by DM MARKETING OÜ, DM MARKETING OÜ does not need to reimburse the customer a cost that exceeds the cost associated with the normal delivery method.

7. Force Majeure
7.1. DM MARKETING OÜ is not responsible for the damage caused to the customer or for the delivery of the goods if the loss or delivery of the goods is due to circumstances that DM MARKETING OÜ could not influence or foresee.

8. Processing of personal data
8.1. The online store only uses the personal data entered by the purchaser (including name, phone number, e-mail and bank details) for processing the order and sending goods to the purchaser. The online store forwards personal data to payment center (Maksekeskus) and to the logistic service provider in order to deliver the goods.
8.2. DM MARKETING OÜ has the right to use the contact details of the customer to provide advertising and other information to the customer.
8.3. The customer has the right at any time to prohibit the collection and use of their personal data, unless this is necessary to recover a claim arising from a contract or to deliver the goods.
8.4. For encrypted data communications with banks for purchases the customer guarantees the security of their personal banknotes and online store does not have access to the web pool.

9. Claims procedure
9.1. DM MARKETING OÜ is responsible for the contractual terms of the goods sold to the customer for non-compliance or deficiency which already existed at the moment of transfer.
9.2. The customer has the right to contact DM MARKETING OÜ at the latest within 14 days by sending an e-mail to abi@dmm.ee or by calling +372 56977470.
9.3 DM MARKETING OÜ is not responsible for any defects that have occurred after the delivery of the goods to the customer.
9.4. If there is a deficiency in the goods purchased from DM MARKETING OÜ, for which DM MARKETING OÜ is liable, DM MARKETING OÜ will repair or replace the defective goods. If the goods can not be repaired or replaced, DM MARKETING OÜ will reimburse to the purchaser all fees resulting from the sale contract.
9.5 DM MARKETING OÜ complies with the complaint filed by the consumer in writing or in a format that can be reproduced in writing within 15 days.

10. Settlement of disputes
10.1. If the customer and DM MARKETING OÜ are not able to settle the dispute by agreement, the purchaser may contact the Consumer Dispute Committee. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a customer and the online store. Resolution of disputes by the Consumer Dispute Committee is free of charge for the customer. A customer may also turn to the dispute resolution bodies of the European Union available here.
